Disclout Privacy Policy
Effective date: October 5, 2026
1 Who we are
OMGHey LLC d/b/a Disclout (“Disclout,” “we,” “us,” or “our”) operates disclout.com and the Disclout service. This Privacy Policy explains how we collect, use, disclose, and retain personal information when you visit our website, participate in a Creator Price offer, submit content, contact us, or use our merchant tools.
A Creator Price lets a shopper receive a conditional discount in exchange for creating and posting content about a purchase. This Policy explains the information handling involved. Our Terms of Service at disclout.com/terms separately govern participation and content reuse rights. This Policy does not itself grant a content license or authorize a payment charge.
2 Information we collect
Contact and account information. We collect information you provide, such as your name, email address, social username, account login information where an account is created, and messages you send to support. For merchant users, we also collect business contact information and information about campaigns they configure.
Order and offer information. We receive relevant order information from you and the participating merchant or its commerce platform, which may include order identifiers, purchased items, prices, discounts, purchase and delivery dates, fulfillment or return status, and the contact details needed to administer your offer. Payment-related information may include transaction identifiers, payment status, and limited payment-method details provided by a processor. Payment details entered directly with a merchant or processor are subject to that provider’s privacy notice.
Social account and campaign information. We collect the social profile and post information relevant to participation, such as usernames, profile URLs, account visibility, follower counts, views, likes, comments, shares, engagement metrics, and publication dates. We receive this information from you, publicly accessible sources, participating platforms, and social data providers. We may keep snapshots needed to document verification and campaign performance.
Submitted content. We collect post links, captions, photos, videos, raw files you submit, and information contained in those files, which may include your image, voice, social handle, and other identifiable people. We also collect submission times, verification results, corrections, and campaign history.
Technical information. Our website and service providers collect operational information such as IP address, browser and device type, requested pages, timestamps, referral information, errors, and security logs. We use this information to deliver, troubleshoot, and protect the service. We do not ask for your social account password. Please do not send sensitive personal information, such as Social Security numbers or medical records, through support messages or content submissions.
3 How we use information
We use personal information to provide and administer Creator Price offers; associate orders with submissions; assess account eligibility and available discounts; communicate instructions, reminders, and decisions; verify content and required live periods; monitor campaign performance; administer authorized repayment and refund records; provide merchant reporting; and respond to support requests.
We also use information to detect fraud and abuse, maintain and improve service functionality, protect our systems, resolve disputes, comply with legal obligations, and document accepted terms and permissions. Marketing communications are sent only where permitted by law and with consent where required. Campaign participation does not require consent to unrelated marketing.
4 Eligibility and verification
We use social account metrics, submitted content, and campaign information to assess eligibility, determine Creator Price offers, and verify participation. This may involve automated tools. Automated results may be inaccurate. We do not use campaign content to train general-purpose AI models.
Email legal@disclout.com about inaccurate personal information. We honor rights concerning automated decisions or profiling where applicable law requires.
5 Who receives information
Participating brands. We provide the Brand involved in your offer with relevant order and contact information, social account information, submitted content, campaign metrics, and verification results so it can administer the campaign and use content within the rights you grant. We do not give every participating Brand access to your individual campaign records. A Brand may act as a separate business responsible for its own data practices; its privacy notice applies to its independent uses.
Service providers. We disclose information as needed to providers supporting hosting, storage, email delivery, commerce integrations, social data retrieval, payment processing, content analysis, security, and customer support. We require appropriate restrictions on their use of information when they process it on our behalf.
Legal and business purposes. We may disclose information where necessary to comply with law or valid legal process, investigate fraud, protect rights and safety, or establish or defend legal claims. Information may also be transferred in connection with a merger, acquisition, financing diligence, or sale of business assets, subject to appropriate confidentiality and applicable privacy requirements.
At your direction. We may disclose information when you direct us to or give appropriate permission. We may also use and disclose aggregated or deidentified reports that do not reasonably identify you, subject to applicable restrictions against reidentification.
6 Public posts and licensed content
Content you publish on a public social account is accessible to other people and is governed by that platform’s privacy settings and terms. Disclout and the Brand may publish and reuse campaign content, including the name, handle, image, and voice associated with it, within the license in the Creator Price offer and our Terms of Service. Reuse may include websites, social channels, email, and paid advertisements.
Once published, content may be copied or redistributed by others beyond our control. A request to delete personal information will be assessed under applicable law, including any lawful retention exception and relevant content permissions. A content license does not override privacy rights that cannot legally be waived. If your request concerns a Brand’s separate use, we may direct you to that Brand or coordinate with it where required.
7 Cookies and advertising
We use essential cookies and similar storage technologies to operate the service, maintain sessions, remember required offer information, and support security. Our website does not use optional visitor analytics cookies or advertising pixels. Operational logs and campaign performance measurement described above are separate from optional website tracking.
We do not sell personal information or share it for cross-context behavioral advertising. Brand use of licensed campaign content in advertisements is described in Section 6; it does not mean that our website tracks visitors for advertising.
You can control cookies through your browser, although blocking essential storage may prevent parts of the service from working. We honor legally required opt-out preference signals, including Global Privacy Control, where applicable. Browser “Do Not Track” signals do not have a uniform technical standard, and we do not currently respond to them separately. We will update this Policy and provide legally required choices before introducing optional analytics or advertising tracking.
8 How long we retain information
We retain personal information only as long as reasonably needed for the purposes described in this Policy. The period depends on the information and its purpose: order and campaign records may be needed through completion, the required posting period, and related dispute or accounting periods; technical logs may be needed for troubleshooting and security; and licensed content may be retained for the duration of permitted reuse.
We may retain limited records longer when required by law, to document rights and permissions, resolve disputes, prevent fraud, or comply with a legal hold. We delete or deidentify information when it is no longer needed. Copies in backups may remain until those backups are overwritten through their normal lifecycle and are subject to the same protections. Retention and deletion remain subject to applicable legal requirements.
9 Your choices and privacy requests
Email legal@disclout.com to ask about your information or make a privacy request. Depending on your location and the laws that apply to Disclout, you may have rights to access or receive a copy of personal information, correct inaccuracies, request deletion, withdraw consent, object to or restrict certain processing, or opt out of legally covered sales, sharing, targeted advertising, or certain profiling. You may also have a right to appeal a denied request or complain to a privacy regulator.
We may ask for information reasonably necessary to verify your identity and authority. Authorized agents may submit requests where permitted by law, subject to appropriate verification. We will respond within the time required by applicable law and explain any lawful reason we cannot fully honor a request. To appeal a decision, reply to our response or email legal@disclout.com with “Privacy appeal” in the subject. We will not unlawfully discriminate against you for exercising privacy rights.
You may unsubscribe from marketing emails using the link provided. We may still send necessary transactional messages about an active offer. You can choose not to provide optional information, but information needed to verify eligibility or administer an offer may be required for participation. We will explain relevant consequences of a deletion or withdrawal request; making the request itself does not automatically trigger discount repayment.
10 Security and processing locations
We use reasonable administrative, technical, and organizational safeguards appropriate to the information we handle. No website, storage system, or transmission method is completely secure. Please use secure account credentials and contact us promptly if you suspect unauthorized access.
Disclout is based in the United States. Information may be processed in the United States and other locations where our providers operate. Those locations may have different privacy laws. Where applicable law requires safeguards for international transfers, we will use an appropriate lawful transfer mechanism. Use of the website alone is not treated as consent to waive protections required by law.
Where European or UK data protection law applies, our processing bases may include performing a contract with you, complying with legal obligations, legitimate interests in operating and protecting the service where those interests do not override your rights, and consent where required. You can contact us to ask which basis applies to a particular use. Withdrawing consent does not affect processing lawfully performed before withdrawal.
11 Children and other services
Creator Price participation is intended for adults aged 18 or older. We do not knowingly collect personal information directly from children under 13. If you believe a child has provided personal information without appropriate authorization, contact legal@disclout.com so we can investigate and take appropriate action. Adults submitting content depicting a child must have appropriate permission and follow the content requirements in our Terms.
Links, merchant storefronts, payment services, and social platforms have their own privacy notices. This Policy covers Disclout’s handling of information and does not replace those notices.
12 Changes and contact
We may update this Policy as our service or legal obligations change. We will update the effective date and provide additional notice or obtain consent where required by law. Changes will not authorize materially different uses of previously collected information without any notice or permission required by law.
